A. CHOICE ATHLETICS RELEASE OF LIABILITY
a. In consideration of being allowed to participate in any way in Choice Athletics indoor training facility, related events and activities, the undersigned acknowledges, appreciates, and agrees that:
b. The risks of injury and illness (ex: communicable diseases such as MRSA, influenza, and COVID-19) from the activities involved in this program are significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce these risks, the risks of serious injury and illness do exist; and,
c. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releasees or others, and assume full responsibility for my participation; and,
d. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,
e. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release and hold harmless Choice Athletics their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“releasees”), with respect to any and all injury, illness, disability, death, or loss or damage to person or property, whether arising from the negligence of the releasees or otherwise, to the fullest extent permitted by law.
B. CHOICE ATHLETICS PERMISSION FOR USE OF IMAGE, NAME AND LIKENESS
a. I hereby grant Choice Athletics permission to use my likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration.
b. I understand and agree that all photos will become the property of Choice Athletics and will not be returned.
c. I hereby irrevocably authorize the Choice Athletics to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo.
d. I hereby hold harmless, release, and forever discharge the Choice Athletics from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.
C. RULES OF CONDUCT
- Choice Athletics’ waiver must be signed before any individual or team is permitted to rent any training areas including the automated pitching machine.
- Alcohol or drugs are not permitted in or on the facility premises.
- Any harassment including but not limited to bullying, intimidation, direct insults, malicious gossip, and victimization will not be tolerated.
- Food or drinks are not permitted on any turf areas, excluding water, but Including gum and sunflower seeds.
- Turf or indoor athletic shoes only, no cleats.
- An adult or coach is required to accompany anyone under the age of 14 renting a turf training area with a manual pitching machine.
- Manual pitching machines are not to exceed 75 miles per hour without direct permission from Choice Athletics on-site operator.
- Batters must always wear helmets inside any training area.
- Pitchers and coaches must use an L-screen if there is a batter in any training area.
- Catchers are required to have and wear proper catching equipment and protective gear.
- Training area doors to be closed while in use.
- No swinging bats or throwing balls outside of training areas.
- Do not lean or hang on nets.
- Place all baseballs and softballs in the bucket when rental time has expired.
All Rental Times include set up and clean up!
Anyone found not following any of the rules listed above or acting inappropriately will be punished; severity of the punishment will depend on the severity of the offence and may include reprimands, and or suspension of membership and purchases.
